In 2005, the Medicare appeals process changed for the first time in over 25 years. At that time, attorneys from Wachler & Associates, P.C., were called upon to author an article on the topic of the revised Medicare appeals process for the American Bar Association Health Law Section publication, The Health Lawyer, which is distributed to 11,000 business and healthcare attorneys nationwide. In 2008, as the Recovery Audit Contractor (“RAC”) demonstration program came to an end and healthcare providers and suppliers began to brace themselves for the permanent RAC program, attorneys from Wachler & Associates, P.C., were again asked to author an article for The Health Lawyer on the topic of RACs. During the RAC demonstration program, our firm represented healthcare entities in three demonstration states. During this time, while arguing the merits of the denied claims and employing legal defenses, our firm continued to experience very successful results in the appeals process.
